New York Governor Kathy Hochul has signed off on a bill that prevents squatters by changing the legal definition of “tenant.” A tenant is now defined, in part, as someone who is not a squatter. This rule change gives police the ability to remove someone who is a squatter by definition instead of having to refer the legal lessee or homeowner to civil court. Under the previous definition of “tenant,” a squatter could often claim tenancy and receive rights awarded under that status. Such instances have played out nationwide, especially in recent, highly-publicized cases in New York City. This bill was added to the state’s budget at the last minute and passed overwhelmingly.
