A letter from Michael Cohen’s own lawyer dated back to 2018 has essentially destroyed the case against Donald Trump. Manhattan District Attorney Alvin Bragg is attempting to prosecute Trump on allegations going back to 2016 during the Presidential campaign cycle. Trump’s former lawyer, Michael Cohen, is the key witness. The letter, however, contradicts the allegations Cohen is currently making against Trump.
It is important to have some backstory to understand why the letter is important. The basic story is as follows. Trump allegedly had an affair with adult star Stormy Daniels. Michael Cohen paid $130,000 to Stormy Daniels from his own personal pocket. Cohen alleges that Trump reimbursed him through a back channel of his businesses. This transaction could be considered a misdemeanor in New York due to Trump improperly documenting the cash transfer.
There is a two-year statute of limitations on misdemeanors in the state, so the accounting error charge cannot stick. The only way this charge sees the light of day is if it is upgraded to a felony. To prove the felony offense, Bragg would have to jump through proverbial hoops of fire. The entire case is a stretch beyond imagination.
In the midst of all of this, a letter from 2018 has resurfaced. This letter was written by Michael Cohen’s personal lawyer to the Federal Election Commission (FEC). In the letter, the lawyer states that Michael Cohen paid Stormy Daniels (Stephanie Clifford) out of his own money and was not reimbursed by Trump or anyone linked to Trump. The letter also states that the payment does not represent a campaign expenditure.
Everything that Alvin Bragg is basing the case against Trump on is dismantled by the letter written by the lawyer of his star witness, Michael Cohen. Trump stated that he thought he would be arrested on Tuesday. As of Thursday, there has been no action. In order for Trump to be arrested, the Grand Jury must meet and agree to charge him. The Grand Jury meeting in New York has been postponed several times. And the reason why they have been delayed is probably that Bragg is kicking the can down the road, just buying time until the case is inevitably thrown out.
